Welcome to Elly Child Care (“Elly Child Care”, “Company”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website https://www.ellychildcare.com/ (“Website”). 

By accessing or using this Website, you agree to be legally bound by these Terms. If you do not agree, you must discontinue use immediately.

By accessing this Website, submitting forms, registering, applying for programs, or otherwise interacting with us, you confirm that: 

  • You have read and understood these Terms. 
  • You agree to comply with them.
  • You are legally competent to enter into a binding agreement under Indian law. 

2. Changes to Terms

We reserve the right to modify or update these Terms at any time. Updated Terms shall become effective upon publication on the Website. Continued use after such updates constitutes acceptance of the revised Terms.
 

 3. Access to the Website

Access is provided on a temporary basis. We may suspend, withdraw, or modify services without notice. We are not liable for any unavailability of the Website. 

 4. Intellectual Property Rights

All content including text, logos, course materials, graphics, software, downloads, and other materials are owned by Elly Child Care or its licensors and are protected under applicable intellectual property laws of India. 

You are granted a limited, non-exclusive, non-transferable license for personal, non-commercial use only. 

Unauthorized reproduction, distribution, or commercial use is strictly prohibited. 

 5. Data Protection & Privacy (DPDP Act Compliance)

Your use of this Website is governed by our Privacy Policy. 

Elly Child Care processes personal data in accordance with: 

  • The Digital Personal Data Protection Act, 2023 
  • The Information Technology Act, 2000 
  • Applicable IT Rules 

5.1 Lawful Basis of Processing 

Personal data is processed only for lawful purposes including: 

  • Course enrollment and administration 
  • Student and parent communication 
  • Recruitment processing 
  • Website improvement and analytics 
  • Legal and regulatory compliance 

Processing is based on consent or other lawful grounds permitted under applicable law. 

5.2 Consent and Withdrawal 

Where consent is required: 

  • Consent is obtained through clear affirmative action. 
  • You may withdraw consent at any time by contacting us. 
  • Withdrawal will not affect processing already completed prior to withdrawal. 

 5.3 Data Principal Rights 

As per the Digital Personal Data Protection Act, 2023, you have the right to:

  • Request erasure of personal data 
  • Withdraw consent 
  • Seek grievance redressal 
  • Nominate another person to exercise rights in case of death or incapacity

  • We do not undertake behavioural tracking, profiling, or targeted advertising directed at children. 
  • Any collection of student data is strictly limited to educational purposes. 

Parents/guardians may exercise data rights on behalf of minors. 

 
5.5 Data Retention 

Personal data is retained only for as long as necessary to: 

  • Fulfill the purpose for which it was collected, 
  • Comply with legal obligations, 
  • Resolve disputes and enforce agreements. 

Thereafter, data is securely deleted or anonymized.

  • Encryption (where applicable)

However, no system is completely secure.

Where required under applicable law, including the Digital Personal Data Protection Act, 2023, we shall notify the affected Data Principals and the competent regulatory authority within the prescribed timelines. 

5.9 Conflict Between Terms and Privacy Policy 

In the event of any inconsistency between these Terms & Conditions and the Privacy Policy with respect to matters relating to personal data protection and processing, the provisions of the Privacy Policy shall prevail. 

 6. User Conduct

You agree not to: 

  • Violate any applicable law or regulation. 
  • Upload unlawful, defamatory, infringing, or harmful content. 
  • Attempt unauthorized access to systems. 
  • Introduce malware or malicious code. 
  • Use automated tools for data extraction without permission. 

6.1 Accuracy of Information 

You agree that all information provided by you to Elly Child Care through the Website, including registration details, student information, or application data, shall be accurate, complete, and up to date. You shall be responsible for the authenticity of such information. Elly Child Care shall not be liable for any consequences arising from inaccurate or misleading information provided by you.


7. Third-Party Links

We may provide links to third-party websites. We do not control or assume responsibility for third-party content or privacy practices. 

 8. Registration and Accounts

If you create an account or submit information: 

  • You must provide accurate and complete information. 
  • You are responsible for maintaining confidentiality of credentials. 
  • We may suspend or terminate accounts for violations. 

 9. Limitation of Liability

To the maximum extent permitted by law, Elly Child Care shall not be liable for: 

  • Indirect, incidental, consequential, or punitive damages. 
  • Loss of data, profits, or business interruption. 
  • access caused by third-party actions beyond our reasonable control. 

Nothing in these Terms limits liability where such limitation is prohibited by law. 

 10. Indemnification

You agree to indemnify and hold harmless Elly Child Care, its directors, employees, and affiliates from claims arising from:

  • Your misuse of the Website. 
  • Your infringement of third-party rights.

 12. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. 

Courts located in Bengaluru, Karnataka, India shall have exclusive jurisdiction. 

13. Force Majeure

Elly Child Care shall not be liable for any failure or delay in performance of its obligations under these Terms where such failure or delay is caused by events beyond its reasonable control, including but not limited to natural disasters, acts of government, cyber-attacks, technical failures, power outages, pandemics, or other force majeure events.
